ANNOTATION
Shevchenko N. L. Administrative law enforcement of human rights in law enforcement agencies of Ukraine. - Qualifying scientific work on the rights of manuscripts.

The dissertation presents a solution to the scientific task of developing the foundations and administrative tools concerning the administrative and legal provision of observance of human rights in law enforcement agencies of Ukraine.
The legal nature of historical and natural values inherent in a modern person, which law enforcement officials must abide by performing their functions, are
disclosed.
It is proved that the public administration requires a permanent
administrative control - public, departmental and out- departmental (administrative prosecutor’s office, the Verkhovna Rada’s of Ukraine Commissioner on human rights and judicial).
The leading role of civil society (mass media, public organizations, non
governmental scientific and expert institutions, public groups in social networks, alternative private small TV channels in quot;YouTubequot;, etc.) has revealed in ensuring the observance of human rights and freedoms while protecting them Irom certain quot;turncoatquot; from the environment of law enforcement, or unwilling to law
enforcement agencies to carry out their functions in a conscientious manner to
protect the rights, freedom and legal intrusions of individuals and legal entities.
It is proved that ensuring the observance of human rights in law enforcement agencies of Ukraine is a system of foundations and administrative tools of
administrative activity of the community, administrative departmental and out- departmental agencies and the administrative court, concerning creation of reliable conditions for prevention and minimizing violatio ns of human rights and freedoms by officials of law-enforcement agencies, restoration of violations the rights and freedoms and bringing the perpetrators to administrative or creation of conditions the perpetrators of these persons.
It is proved that the majority of historically determined human and civil
rights and freedoms are provided by law-enforcement agencies of Ukraine, or they may be potentially violated by them.
It is found out that the core and system of human rights and freedoms, the standards of their enforcement, whic h are influenced by law enforcement agencies, as a complex of natural and immutable freedoms and legal possibilities of four
historical generations, which are provided by law enforcement agencies, can be identified or potentially violated. It is determined that the most important and those that directly provide law enforcement officials are the right to life, freedom and
safety of a person, the right to protection against unwarranted arrest, detention, the right to an independent and impartial court for legal disputes and protection against accusations.
It is determined that the main task of the police is to provide police services for the protection of human rights and freedoms on the basis of the rule of law
principle, which taking into account the practice of the European Court of Human Rights. Having its main duty to respect human rights and freedoms, with minimum legislative exceptions, on the grounds and in the manner prescribed by the
Constitution and laws of Ukraine, which may be related primarily to the urgent
need to protect the life and health of some people from the public dangerous
encroachment of other persons.
It is proved that the meaning of administrative and legal support for the
observance of human rights of law enforcement agencies of Ukraine is a system of principles and measures of administrative activity of public administration, for prevention of violation, restoration in case of vio lation, and bringing the guilty to administrative responsibility and creating conditions for bringing to administrative responsibility of officials law enforcement agencies of Ukraine, whic h violate the rights and freedoms on the legitimate interests of individuals and legal entities.
It is revealed that a significant number of individual administrative acts is devoted to the implementation of human rights in law enforcement agencies is issued by the Verkhovna Rada’s of Ukraine Commissioner on human rights, in
particular, Order of February 16, No. 2/02, approved the quot;Plan of Measures to Implement the National Strategy for Human Rights for the Period until 2020». It is proved that the specific form of administrative activity of the Verkhovna Rada’s of Ukraine Commissioner on human rights is the signing of a Memorandum of Cooperation with the Ukrainian Helsinki Human Rights Union within the implementation of the National Strategy for Human Rights.
It is determined that the forms of administrative activity of the public
administration in ensuring the observance of human rights in law enforcement agencies of Ukraine are a system of the similar kind and legal nature groups of
administrative actions that have an external expression and with the help of whic h the observance of human rights is observed in the law-enforcement agencies of Ukraine, which include: publication of normative administrative acts, which approve the states of territorial units, and the law-enforcement agency as a whole; the publication of individual administrative acts that adopt strategies and specific decisions regarding the prevention of disproportionate use of force and special
means, the practice of non-compliance with procedural legislation by law
enforcement officers, which leads to arbitrary deprivation of liberty, the introduction of an effective system of independent control over the activities of
law-enforcement agencies in terms of observance of the right to privacy; the
implementation of other legally significant actions, when all, without exception, law enforcement officers take oath, and the maintenance of various registries as a special form of material and technical operatio ns.
It is determined that the prosecutor’s oversight of the observance of laws by law enforcement agencies conducting operatio nal search activities, inquiries, pretrial investigations using procedural and investigative rights and performing duties by providing written instructions that are immediately enforceable, in addition, the prosecutor exercises supervision for observance of laws when applying measures
of influence over administrative violations by supervising the observance of laws in the application of coercive measures related to the restriction m personal
freedom of citizens was revealed (Art.
7 CUAO). These norms of administrative law are secured by violation of measures of administrative coercion (Artic le 185-8 quot;Evasion from the execution of lawful demands of the prosecutorquot; CUAO).It is proved that among administrative tools the leading place in direct
enforcement of human rights in law enforcement agencies belongs to the methods of administrative activity of public administration. Such methods include some promotion measures and a wide range of methods of persuasion (legal education, participation of the applicant in conducting disciplinary proceedings against an official, automatic registration of all visitors of administrative premises of law
enforcement agencies, public control of local communities, and negotiations on the issues of ensuring freedom of peaceful assemblies). Partic ular attention is paid to the development and implementation of measures to prevent the violation of the
rights of people in pre-trial detention. Administrative preventive measures, as a form of administrative coercion, consist in the fact that public administration has
the power to restrict its discretion by creating an effective system for investigating
crimes involving torture, cruel, inhuman or degrading treatment. Supervisory practices of the prosecutor’s office for complying with the law by law enforcement agencies conducting search operations, inquest, pre-trial investigation, and compensatory payments from the state budget to victims of violent crimes that
have lost their lives or health from abuse or inactivity of law enforcement agencies.
It is determined that the world community based on the international legal documents of the UN and the Council of Europe has developed rules for the
observance of human rights and freedoms in law enforcement agencies. The
standards of which include indisputable humanitarian virtues: the absolute right to life; the right to liberty and safety of person; the right to own property freely; the right to road safety; the right to a fair trial of a legal dispute within a reasonable time by an independent and impartial tribunal; respect for private and family life; privacy and correspondence; the duty of the police to protect and not violate the
rights and freedoms of people; the prohibition of torture, torture or other forms of humiliating treatment of a person, including in places of legal deprivation of
liberty.
It is proposed to finalize and adopt the draft of law quot;About the Financial
Investigation Service of Ukrainequot; as the only law enforcement agency
subordinated to the Ministry of Finance of Ukraine, which would have the
competence to carry out operative and investigative measures on economic crimes, thus depriving the police and the Security Service of Ukraine of this right.
To establish administrative responsibility for violating the rights and lawful interests of persons in places of deprivation of liberty by supplementing CUAO Art. 187-1 quot;Violation of the rights and legitimate interests of persons are held in investigative detention facilities, penitentiary institutionsquot; in the following disposition: quot;Violation of the rights and legitimate interests of persons are held in investigative detention facilities, penitentiary institutions, or failure to create proper sanitary and hygiene the conditions for their maintenance - entails a
warning or imposing on officials a fine of fifteen to twenty five tax-free minimum incomes, and / or deprivation of the right to hold civil servants from one to three
years. The right to draw up protocols on administrative violations under this article shall be imposed on officials of the central executive authority agency, which
carries out state policy in the field of execution of criminal penalties and the
Verkhovna Rada’s of Ukraine Commissioner on human rights, and the right to make a ruling imposed on court.
The practical significance of the obtaining results is that the theoretical positions formulated and substantiated in the dissertation have been implemented and can be further used in the research area for the further scientific development
of problems of ensuring the observance of human rights and freedoms in law
enforcement agencies; law-making - in relation to the improvement of the current legislation in matters of ensuring the observance of human rights and freedoms in law-enforcement agencies; the educational process during the preparation of training manuals and the course of lectures of disciplines quot;Administrative Law of
Ukrainequot;, quot;Judicial and law-enforcement agencies of Ukraine”; in law enforcement activity - to improve the effectiveness of ensuring the observance of human rights in the units of the national police of Ukraine.
